The Client: The company or individual requesting the services of S H Mohanjith.
S H Mohanjith: S H Mohanjith.

General

S H Mohanjith will carry out work only where a written purchase order is provided either by mail or e-mail.

S H Mohanjith will carry out work only for clients who are 18 years of age or above.

Website Design and Development

Copyrights and Ownership

All graphics and programming code written by S H Mohanjith remain the copyright of S H Mohanjith and may not be resold or reproduced with out the explicit written consent of S H Mohanjith.

All graphics, programming code and websites remain the property of S H Mohanjith until all fees are paid. Once the account is paid in full, rights are assigned to you to use the website.

S H Mohanjith cannot take responsibility for any copyright infringements caused by materials submitted by the client. I reserve the right to refuse any material that is deemed of a copyrighted nature unless there is proof that you have permission to use the said material.

Scope of a project

The scope of a project is defined to the client before payment. After initial payment is received any additions to the brief are considered as additional projects and thus S H Mohanjith will charge for them accordingly.

Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, S H Mohanjith cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.

Submission of materials

The client agrees to submit required materials as soon as is reasonably possible to S H Mohanjith. S H Mohanjith will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Errors, Bugs and Compatibility

S H Mohanjith will make every effort to make sure all work completed is error/bug free and that the website is compatible across all major browsers(Internet Explorer 7/8, Firefox 1/2/3, Safari 3/4) . S H Mohanjith cannot guarantee that the website will display correctly in minor browsers.

S H Mohanjith tests all websites and web applications before handing them over the the client. However the client is expected to fully test a website before making it generally available to the public. Any Errors/Bugs found after the site is live will be corrected to meet the standards defined in the brief. S H Mohanjith can not be held responsible for any losses incurred by the client in using any software created by/for the client. While every effort has been made to create accurate and reliable software, the responsibility belongs to the client to fully test the website.

Payment of Accounts

A deposit of 40% of the cost of the project is required before any work is carried out. In all cases any additional costs incurred to S H Mohanjith (such as customer specified software) are required to be paid in advance and are non-refundable.

Complete payment is expected within 7 days from the date of invoice unless otherwise agreed prior to payment. Should the client refuse to pay or does not inform S H Mohanjith as to the reason for the delay the client will be refused access to the website. Continuing failure to pay any outstanding balances may lead to legal action against the client.

When working on larger projects the client will be expected to pay a percentage of the invoice at specified mile stones. Milestones are defined within the quote for the project. Failure to pay at specified milestones without reason may result in the cancellation of the project. Money paid at milestones is non-refundable.

Cancellation of projects

The client retains the right to cancel a project at any time. In cancelling a project the client is still responsible for any work completed up to the point of cancellation. Upon cancelling a project the client will be given an updated invoice for any work completed yet unpaid for.

S H Mohanjith retains the right to cancel a project in cases where circumstances prevent the completion of the project. In such cases the client will receive a full refund on any money paid up to the point of cancellation.
